Romania will apply the e-Invoice system generalized, from January 1, 2024, for all transactions between companies (taxable persons) established in our country.

The system is operational from 2022, but is only be mandatory for invoices issued by private companies in their dealings with state entities (B2G), for invoices relating to tax-risk goods and for travel agencies issuing invoices based on holiday vouchers.

Our country has asked the European Commission (EC), as early as January 2022, for a derogation from EU VAT legislation to extend the scheme to all commercial transactions.

Therefore, the draft decision will first establish that "Romania is authorized to accept invoices issued by taxable persons established on the territory of Romania in the form of documents or messages only if those documents or messages are transferred in electronic format".
Secondly, it will state that "Romania is authorized to provide that the use of electronic invoices issued by taxable persons established in Romania is not subject to acceptance by the recipient established in Romania".
These are the same derogations Poland received from the European Commission to use the e-Invoice system from this year until 2026.

The derogation for Romania will be valid, in principle, between 2024 and 2026 , and the measure will not apply to taxable persons not established on the territory of Romania , with the possibility of extension on the basis of a new reasoned request from Romania.

In conclusion, Cersanit romania should prepare for the implementation of the RO e-Invoice system from 1 January 2024. (The EU Council''''''''s approval of the Commission''''''''s proposal now just a formality).

In this respect, we need to identify as soon as possible the most suitable IT solutions for our business model.
